Moreton Bay Council has specific restrictions regarding tree removal on private land. Whether you can remove a tree depends on whether your property falls within the Environmental Areas Overlay.

Do You Need Council Approval to Remove a Tree?

You can remove a tree from private property without approval, provided it is not:

  • Located within the Environmental Areas Overlay.
  • Located in a Limited Development Zone, such as:
  1. Caboolture West Local Plan – Green Network Precinct.
  2. Riparian and Wetland Setbacks;
  3. Water Supply Buffer.

Habitat Trees are native trees with a trunk diameter greater than 0.8m, measured at 1.3m above the ground. These trees often have large canopies and hollows, providing habitat for wildlife.

Exemptions for Tree Removal

The following exemptions apply for tree removal in Moreton Bay:

  • Clearing within an approved development footprint.
  • Clearing necessary for emergency access or to prevent risk to infrastructure.
  • Emergency removal of a dangerous tree.
  • Removal to construct or maintain a property boundary fence.
  • Clearing within an easement for public infrastructure or drainage.
  • Clearing according to a bushfire management plan approved by the council.
  • Removal of weed species, windbreaks, or maintaining lawns, gardens, or pastures.
What About Dead Trees?

Dead trees that pose a risk to property or people can be removed without council approval. However, if a dead tree is currently serving as habitat (e.g., for possums), it may require further consideration. Dead trees quickly become unstable and can be removed under the exemption for preventing injury or damage.

How to Apply for a Tree Removal Permit

If your tree is not covered by any exemptions, you will need to lodge a request with the Moreton Bay Council. Once submitted, a council arborist will inspect the tree to determine if it can be removed. In some cases, you may need to provide a third-party arborist report to support your application.
